Contest Terms and Conditions for Instagram and Facebook

§ 1 General

Participation in the contest of the Instagram page: "vigor_equipment_official" and/or the Facebook page "VIGOR Equipment" (hereinafter referred to as "the organizer") is only possible under inclusion of these terms and conditions of participation. The contest is not supported by Instagram or Facebook and has no connection to Instagram or Facebook.  

§ 2 Participation Requirements

By participating in the contest, the Instagram user expressly acknowledges these general terms and conditions of participation. All natural persons with legal capacity and a minimum age of 18 years may participate. Employees of the organizer and their relatives are excluded from participation. Participation is only possible via personal Instagram/Facebook registration (one's own Instagram/Facebook account). If the organizer becomes aware of technical manipulations or another violation of these terms and conditions of participation, he will exclude the participant from the contest. Technical manipulation includes, among other things, multiple registration of one person, participation via a contest service or similar automated collective participation services. In these cases, the prize can also be revoked subsequently and a replacement winner can be drawn. By participating, the participant agrees that in case of winning, his/her name and/or image will be published on the internet. Participation is only possible within the deadline stated in the contest description. Legal recourse is excluded.  

§ 3 Prize

The prize will be awarded as advertised in the contest. A change or cash payment of the prize is excluded. The winner will be notified by us as described in the contest. If the winner does not respond to the prize notification within the deadline we set, the prize is forfeited without replacement.  

§ 4 Liability

Claims for damages against the organizer in connection with the contest are excluded – within the legally permissible scope – regardless of legal grounds, unless the organizer had intentionally or grossly negligently violated legal obligations. Furthermore, the organizer is not liable for damages from impairment of the availability of the contest website in case of uncontrollable technical disruptions and force majeure events, as well as attacks by third parties against the contest website. However, the organizer will undertake everything to ensure the reliability and functionality of the contest website. Furthermore, the organizer does not guarantee that the contest website functions properly on the respective participant's computer.   

§ 5 Data Protection

The organizer maintains the highest data protection standards within the framework of this contest and observes the relevant legal provisions, in particular requirements of the EU General Data Protection Regulation (GDPR). Insofar as participants communicate with the organizer via social media (e.g. Facebook, Instagram) within the framework of this contest (e.g. through comments or sending messages), the legal basis for processing the personal data obtained in this way is the legitimate interest of the organizer in communication with the participants (Art. 6 para. f GDPR) as well as, where applicable, the fulfillment of contractual or pre-contractual obligations (Art. 6 para. b GDPR). The social networks otherwise only provide aggregated data to the organizer that do not allow conclusions about individuals. The organizer processes the personal data of the participants exclusively for the purpose of conducting the contest. After completion of the contest, the data will be deleted. No personal data are passed on to third parties by the organizer. § 6 Premature Termination of the Contest

The organizer reserves the right to change the contest due to unforeseen circumstances without prior notice regarding the contest components, to abort or terminate the contest. The latter applies in particular if software and/or hardware errors occur, and/or other technical and/or legal reasons influence or make impossible the regular and proper conduct of the contest.   

§ 7 Severability Clause

Should individual provisions of these terms and conditions of participation be invalid or a regulatory gap exist, this does not affect the validity of the remaining provisions. In place of the invalid or missing provisions, a provision shall apply which comes closest to the contractual purpose and the legal provisions.   

§ 8 Jurisdiction/ Applicable Law

In case of disputes, exclusively German law applies. As jurisdiction, insofar as legally permissible, the seat of the organizer is agreed. Insofar as the participant has no general jurisdiction in Germany, or relocates residence abroad after participation, the seat of the organizer is likewise agreed as jurisdiction. Legal recourse is excluded.   

§ 9 Selection Process
